§ 1 Scope
These terms apply to the use of Finqo, offered by Accountax, owner Eyline Päpke-Jakubowski (sole proprietorship), Kienberger Allee 4, 12529 Schönefeld, Germany. Finqo is aimed exclusively at businesses within the meaning of § 14 BGB. The customer's own terms do not apply.
§ 2 Service
Finqo is a web-based finance cockpit that processes data from DATEV and connected bank accounts (via finAPI): liquidity, cash flow, management accounts (BWA), open items, deadline overview, planning and AI-assisted categorisation with approval. Finqo is a software tool; it does not provide tax advice or bookkeeping within the meaning of the StBerG. DATEV data remains authoritative for bookkeeping and taxes.
§ 3 Conclusion of contract
The contract is concluded when the offer is accepted or access is activated.
§ 4 Customer obligations
- keep login details secret,
- use two-factor login,
- invite only authorised persons,
- check reports and AI suggestions before use,
- maintain any necessary contracts with DATEV and banks themselves.
§ 5 Availability
We aim for 99% on a monthly average, excluding announced maintenance. Outages of third-party systems (DATEV, banks, finAPI) are beyond our control.
§ 6 Prices, trial and payment
(1) The prices shown on finqo.de at the time of contract or agreed in the offer apply, plus VAT. Plans currently cost, per company, net per month with monthly or annual billing: Cashflow €59 / €49, Essential €149 / €129, Pro €249 / €219. Each additional company costs €49 net per month, connecting your own DATEV licence €69 net per month.
(2) New customers can try Finqo free for 14 days; starting with demo data is possible. If the customer does not take out a subscription by the end of the trial, the trial ends automatically and free of charge.
(3) Payment is made in advance by card or SEPA direct debit via our payment provider Stripe, monthly or annually depending on the billing period chosen. We provide invoices electronically. We announce price changes six weeks in advance; the customer may then cancel as of the date of the change.
§ 7 Term and cancellation
(1) Monthly plan: the contract renews for one month at a time and can be cancelled at the end of the month.
(2) Annual plan: the contract runs for twelve months and renews for another twelve months unless cancelled by the end of the term.
(3) The trial ends automatically without a subscription; no cancellation is required.
(4) Cancellation is possible with one click in the portal (in Finqo under „Abo & Rechnungen“) or by email to support@finqo.de. The right to extraordinary termination remains unaffected.
(5) We delete the customer's data within 30 days of the contract ending; on request, the customer receives an export beforehand. Details are set out in the data processing agreement.
§ 8 Data and data protection
The customer's data remains the customer's data. We process it on the customer's behalf on the basis of the data processing agreement. Customer data is not used to train AI models. The data processing agreement (DPA) forms part of this contract.
§ 9 Liability
Unlimited in cases of intent, gross negligence, injury to life, body or health, and under the Product Liability Act. In cases of slight negligence only for breach of material contractual obligations, limited to the damage typically foreseeable under the contract, and at most to the annual fee paid in the year of the damage. No liability for decisions based on unchecked reports or AI suggestions.
§ 10 Changes
We announce changes to these terms by email six weeks in advance; the customer may object or cancel.
§ 11 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Berlin, where legally permissible. If any provision is invalid, the remainder stays in effect.
